Separate sealed Bids for the Oakvale Road PSD Wastewater Extension Project – Phase I for the Oakvale Road Public Service District which consists of CONTRACT NO. 1 – (RUS/ARC ELIGIBLE) will consist of approximately 12,540 L.F. of 8-inch PVC gravity sewer, 496 L.F. of 8-inch DIP gravity sewer, 1,415 L.F. of 6-inch service connection lines, 391 L.F. of 4-inch service connection lines, 1,353 L.F. of 2-inch force main, valves, service lines, meter settings, one duplex grinder pump station, and all appurtenances. Achieving substantial completion within 300 days following the issuance of notice to proceed will be received by Oakvale Road Public Service District, at the office of the Mercer County Commission at Mercer County Court House in Princeton, West Virginia 24740 until 1:30 P.M., local prevailing time, on February 13, 2025 and then at said office publicly opened and read aloud.

Box 1061 Princeton, WV 24740; at Thompson & Litton, 1105 Mercer Street, Princeton WV; and online at TRASCO (http://www.trascoplanroom.com). Copies of the Contract Documents (electronic and/or hard copy) are available for purchase through TRASCO at http://www.trascoplanroom.com.
Withdrawal of bids shall be in accordance with the Instructions to Bidders.
Bids must be accompanied by Bid security as specified in the Instructions to Bidders.
1) BIDDERS on this work will be required to comply with the President's Executive Order No. 11246 entitle “Equal Employment Opportunity” as amended by Executive Order 11375 and "HUD Section 109", which prohibits discrimination in employment regarding race, creed, color, sex, or national origin. Neither the United States nor any of its departments, agencies, or employees is or will be a party to this Advertisement for Bids or any resulting contract.
2) BIDDERS must comply with the requirements for Affirmative Action and Minority Business Enterprises participation as described in the Federal Specifications insert to the Contract Documents. BIDDERS must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Copeland Act, the Contract Work Hours and Safety Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21- 5A-3.
This is a federally assisted project. Bidders and Contractors performing work under this advertisement are bound by the requirements of President’s Executive Order 11246 as amended by Executive Order 11375; Title VI of the Civil Rights Act of 1964; Section 109 of Title I of the Housing and Community Development Act of 1974, as amended; Section 3 of the Housing and Urban Development Act of 1968; the Immigration Reform and Control Act of 1986; the Davis-Bacon Act; the Copeland “Anti-Kickback” Act; the Contract Work Hours and Safety Standards Act; and Public Law 100 202.
For the purpose of clarification, it is understood that the work to be done is being financed in whole or in part by means of a grant and loan through USDA Rural Development.
Section 746 of Title VII of the Consolidated Appropriations Act of 2017 (Division A - Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2017) applies an American Iron and Steel requirement to this project. All iron and steel products used in this project must be produced in the United States. The term "iron and steel products" means the following products made primarily of iron or steel: lined or unlined pipes and fittings, manhole covers and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials. The following waivers apply to this Contract: De Minimis , Minor components, Pig iron and direct reduced iron.
Notice is hereby given that Oakvale Road Public Service District has adopted goals for minority and female participation in the project work force. These goals are as follows:
Female Participation:6.9 percent
Minority Participation:4.2 percent
A MANDATORY pre-bid conference will be held on January 23, 2025 at 10:00 a.m. (LPT) at then Office of the Mercer County Commission at Mercer County Courthouse, 1501 West Main Street in Princeton, West Virginia. In the early afternoon following the conference, a field review of the project will be held for all BIDDERS.
A five percent (5%) BID BOND must accompany all BIDS. Bidder Surety Company must be listed on current Treasury Circular 570.
No BIDDER shall be listed on the “Excluded Parties List System” at www.sam.gov in accordance with 2 CRF Part 1532 and Subpart B and C of 2 CFR Part 180.
All BIDDERS must hold a current West Virginia Contractor's License on the date of bid opening.
No BIDDER may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids.
The Oakvale Road Public Service District may waive any informalities or minor defects or reject any and all bids in accordance with West Virginia Code.
Any Contractor submitting a Bid on this project hereby certifies, indicates and acknowledges that he/she has a license and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed. Furthermore, any Contractor submitting a Bid on this project certifies that he/she is not listed on the Disbarment List.
The Contract(s) shall be awarded to the lowest responsive and responsible Bidder(s).
The Owner reserves the right to reject any and all Bids if it appears in its best interest to do so.
